General conditions of use

1.- Object

The terms and conditions contained in these General Conditions of Use (hereinafter also referred to as General Conditions or Conditions), constitute the general conditions regulating access to and use of the Sites belonging to and managed by the owner and provider of information society services BeeDIGITAL AI, SAU, (hereinafter referred to as BeeDIGITAL) with Tax Identification Number A 84619485 and with registered office at Avda. Isla Graciosa, 7, 2ª floor, 28703 San Sebastián de los Reyes, Madrid. Registered in the Mercantile Register of Madrid, volume 22408, page 1, sheet number M-400263. It is registered under number 2011099213287V in the Distance Selling Register. It is also sufficiently authorised by the competent authority to publish an electronic telephone directory.

Some of our Sites have their own Special Conditions which, depending on the case, will complete, modify or replace these General Conditions.

In addition, these Conditions are supplemented by the Privacy Policy of our Sites as well as that of each product or service contained in any of the Digital Presence BeeDIGITAL.

The use of any of BeeDIGITAL’s Sites implies full acceptance of each and every one of the General Conditions contained herein, as well as the Specific Conditions that, where applicable, are established in some Sites.

Within the expression “Sites”, “Site”, or BeeDIGITAL web, the following are included, but is not limited to, this web site as well as any other web sites that the User may access through navigation on this Site, which are also owned and operated by BeeDIGITAL, as well as the data, texts, graphics, images, animations, musical creations, videos, sounds, drawings, photographs, industrial designs, furniture designs and others included therein, and, in general, all creations expressed by any means or support, tangible or intangible.

Access to the Digital Presence BeeDIGITAL implies that the User acquires a series of rights and obligations, in order to guarantee the adequate enjoyment of the general and specific services and contents found therein, which BeeDIGITAL makes available to the User.

The User is aware that access to and use of the services and content of the Sites is at the User’s sole and exclusive responsibility.

User status is acquired by accessing the Sites.

2. Free of charge and no subscription or registration requirement

Access to and/or use of the Digital Presence BeeDIGITAL is free of charge, except for those services indicated in their respective Particular Conditions.

Completion of the registration form is not mandatory to access and enjoy the services offered on the Sites, with the exception of certain services.

3. User registration

In order to access and/or use certain services of the Sites, under registration, the User must assign a User name/s, as well as a password/s, undertaking to make diligent use of both (User name and password) and to maintain the secrecy of the credentials and passwords, thus being liable for all damages resulting from the incorrect and negligent use of the same.

BeeDIGITAL may, at any time and without prior notice, refuse or withdraw the use of our Sites in the event of non-compliance with the Conditions, the Specific Conditions governing a particular service or the Privacy Policy.

4. Minors

Minors under the age of 18 may not use the particular BeeDIGITAL Services that require registration or identification as registered users of the Sites, even with the representation of their parent, guardian or legal representative.

5. Intellectual and Industrial Property

All information contained in the Sites including, but not limited to, databases, graphic design, photographs, logos, trademarks, images, audio, video, documents, source code (HTML and Javascript), and any content published on the Sites, constitutes a work whose intellectual and industrial property belongs to BeeDIGITAL, or to third parties, without the use of or access to the Sites and/or the services offered therein conferring on the User any right over their ownership.

The User shall refrain from reproducing or copying, distributing, allowing public access through any form of public communication, transforming or modifying the services, unless authorised by BeeDIGITAL or the third party holder of the right; suppress, evade or manipulate any data or signs identifying the rights of BeeDIGITAL or its owners incorporated in the services as well as the technical protection devices, and in particular, use information of any kind obtained through the BeeDIGITAL Site or the services to send advertising, communications for direct marketing purposes or for any other commercial purpose, send unsolicited messages addressed to a number of persons regardless of their purpose, as well as to refrain from marketing or divulging such information in any way whatsoever; to obtain any image, recording, software and, in general, any kind of material accessible through the Site by any means other than those made available to Users by BeeDIGITAL.

6. Correct use of the Sites

Any User accessing the BeeDIGITAL Site undertakes to make correct use of the services contained therein, in accordance with the provisions of the applicable legislation in force and with the contents of the General Conditions and, where applicable, the Specific Conditions published on the Site at any given time for each product or service, refraining from any act that may be contrary to the interests of third parties and to the structure and operation of the BeeDIGITAL Site.

Specifically, the User may access the content and services of the Sites available as such free of charge and without the need for prior authorisation, without prejudice to the technical and specific conditions or the need for prior registration with respect to specific services and content, as determined in these general conditions or in the specific conditions of said services.

Under no circumstances may the User:

  • Accessing or using the services and contents of the site for illicit purposes, harmful to the rights and freedoms of third parties, or which may damage, harm or impede in any way, access to the same, to the detriment of BeeDIGITAL or third parties, or in a manner contrary to the legal conditions published on the Sites.
  • Use the services, in whole or in part, to promote, sell, hire, divulge advertising or information of their own or of third parties without prior written authorisation from BeeDIGITAL.
  • Include hyperlinks on its private or commercial web pages to the Sites that are not limited solely and exclusively to access to the home page of the Site and provided that the conditions set out below for links are respected.   • Include “metatags” corresponding to trademarks, trade names or distinctive signs owned by BeeDIGITAL or third parties on the Sites for which it is responsible or property of BeeDIGITAL.
  • Reproduce BeeDIGITAL’s Sites in whole or in part on another website; you may not frame the Sites accessible through this website in such a way as to conceal or modify the content, advertising space and trademarks of BeeDIGITAL or of third parties, whether or not they constitute acts of unfair competition or confusion.
  • Creating frames within third party websites that reproduce the home page and/or the pages accessible through it, corresponding to BeeDIGITAL’s Sites without BeeDIGITAL’s prior authorisation.

BeeDIGITAL reserves the following rights:

  • Modify the conditions of access to the Sites, technical or otherwise, unilaterally and without prior notice to users, without prejudice to the provisions of the specific conditions governing the use of a particular service and/or content.
  • Establishing specific conditions and, where appropriate, a price or other requirements for access to certain services and/or content
  • Limit, exclude or condition user access when not all the guarantees of correct use of the site by users are given in accordance with the obligations and prohibitions assumed by them.
  • Terminate the provision of a service or supply of content, in any case, and in particular, when the same is unlawful or contrary to the conditions established for the same, without prejudice to the provisions of the specific conditions governing the use of a particular service and/or content intended for users of the Sites.
  • Modify, delete or update all or part of the content or services offered through the Sites. without the need for prior notice, without prejudice to the provisions of the specific conditions governing the use of a particular service and/or content.
  • To take any legal or judicial action that may be appropriate for the protection of BeeDIGITAL’s rights.
  • Demand any compensation that may arise from the improper or unlawful use of all or part of the services and content provided through the Sites.

7. Conditions of Use of the Services accessible through the Sites

Commercial communications and newsletters

The User may subscribe to the Services for the sending of commercial communications and newsletters published on the Sites. To do so, the User must provide his/her e-mail address, and in this case, the e-mail address provided by the User to BeeDIGITAL will be used for sending commercial or promotional communications, either by e-mail or any other equivalent means of communication.

User feedback and comments

Some sites incorporate the possibility of giving your opinion on the service/product advertised. The User may ask questions through the suggestion and contact service of the Digital Presence BeeDIGITAL. Under no circumstances will communications sent by the User to these services have the legal status of a complaint, nor can any binding legal effect be derived from BeeDIGITAL’s reply.

8. Protection of personal data

BeeDIGITAL guarantees the confidentiality of personal data provided by users through the Digital Presence BeeDIGITAL and, specifically, for the subscription and use of the particular services and content published on the Sites, and their treatment, in accordance with current legislation on the protection of personal data.

9. Hyperlinks

The User who intends to include any type of link in his web page that implies a hyperlink to the Digital Presence BeeDIGITAL or to any of the pages that make up the Digital Presence BeeDIGITAL must comply with the following Conditions:

  • No false, inaccurate or incorrect statements or indications may be made about the Digital Presence BeeDIGITAL.
  • The hyperlink will only allow access to the Digital Presence BeeDIGITAL and services, but may not reproduce them in any form whatsoever;
  • It shall not be stated or implied that BeeDIGITAL has authorised the hyperlink or that it has supervised or assumed in any way the contents or services offered or made available on the website where the hyperlink is established;

10. Responsibilities

BeeDIGITAL accepts no responsibility for the consequences of non-compliance by the User with the General Conditions of Use or, where applicable, with the Specific Conditions governing certain services contained in any of BeeDIGITAL’s Sites.

All services accessed through our Sites, including any action or the performance of any obligation and/or right between the Users of the Sites and the advertisers, are deemed to be performed between these two parties, and BeeDIGITAL shall not be held liable in any way whatsoever.

In the event of any liability of BeeDIGITAL, BeeDIGITAL shall only be liable for damages actually and directly caused by BeeDIGITAL, and in no case shall it be liable for compensation for loss of profit.

Our Sites may be discontinued or altered without notice, and BeeDIGITAL shall not be liable to the User or to any third party for such action.

BeeDIGITAL is not liable for system malfunctions due to technical conditions or third party causes.

BeeDIGITAL declines all responsibility for the services and content found both outside and inside the Site, and shall not be liable for damages of any kind arising from the lack of availability or continuity of the operation of the services offered on our Sites.

BeeDIGITAL does not control everything contained in the Sites, and is not responsible for any damages that may arise from the existence of any type of virus or other element that may cause alterations in the computer system, nor for any damages that may be caused to the hardware or software of the Users.

The purpose of the links (links, banners, buttons…) that appear on our Sites is to inform the User of the existence of other sources of information on the subject on the Internet, as well as to make it easier for Users to search for and access information available on the Internet; these links do not constitute a suggestion, invitation or recommendation to visit the destination sites, and BeeDIGITAL shall not be held responsible for the results obtained through these links.

Under no circumstances will BeeDIGITAL be liable for information that provides links to other content or includes in its own directories or content search tools, provided that BeeDIGITAL does not have actual knowledge that the information to which it refers is illegal or that it harms the property or rights of a third party liable for compensation and, if it does have such knowledge, it will act diligently to remove or disable the corresponding link. Notwithstanding the foregoing, BeeDIGITAL reserves the right to refuse or remove, at any time and without prior notice, those Users who manifestly engage in illicit activities.

BeeDIGITAL neither controls nor offers any kind of guarantee as to the identity of the Users, nor as to the veracity, validity and authenticity of the data that Users provide about themselves or about other Users; thus not being liable for damages of any kind that may be due to the incorrect identity of Users and to the lack of veracity, validity and authenticity of the information that Users provide about themselves or make accessible to other Users.

BeeDIGITAL is exempt from any liability for damages of any kind in the following cases:

  • Due to the impossibility or difficulty of connection to the communications network through which the Sites are accessible, regardless of the type of connection used by the User.
  • For the interruption, suspension or cancellation of access to the Sites, as well as for the availability and continuity of the operation of the Sites or of the services and/or content contained therein.
  • BeeDIGITAL assumes no responsibility for the services and content, nor for the availability and conditions, technical or otherwise, of access to the same, which are offered by third party service providers, in particular with respect to information society service providers. Information society service providers shall mean natural or legal persons providing the following services to the public:
  • Transmission over a communication network of data provided by the recipient of the service.
  • Access services to the aforementioned network.
  • Data storage or hosting services.
  • Provision of content or information.
  • Temporary copy service of the data requested by users.
  • Provision of links to content or search tools.
  • BeeDIGITAL shall at no time be liable for any damages that may be caused by information, content, products and services – including but not limited to – provided, communicated, hosted, transmitted, displayed or offered by third parties other than BeeDIGITAL – including information society service providers – through a web site that can be accessed through an existing link on the Sites.
  • The further processing and use of personal data by third parties outside BeeDIGITAL, as well as the relevance of the information requested by them.
  • The quality and speed of access to the site and the technical conditions that the User must meet in order to be able to access the Sites and their services and/or contents.
  • BeeDIGITAL shall not be liable for any delays or failures in the access and/or operation of the services and/or content of the Sites due to force majeure.

12. Invalidity and voidability

Privacy Policy

1. Purpose of the Privacy Policy.

In compliance with current legislation on the protection of personal data, BeeDIGITAL AI, SAU (hereinafter “BeeDIGITAL”) wishes to inform users of the Sites of the policy regarding the processing and protection of personal data of those persons who provide their personal data through the personalised use or registration of the services of the Sites or any other act that involves the communication of their personal data to BeeDIGITAL.

Likewise, we inform the user that this Privacy Policy contains a general description of the aspects related to the processing of personal data carried out by BeeDIGITAL as the party responsible for such processing derived from the operation of the Sites.

4. Data on Minors.

5. Accuracy and veracity of the Personal Data.

Users accessing the Sites are not obliged to provide personal information to browse the Sites, therefore, any communication of data for such purposes will be because the user has voluntarily decided on a personalised browsing or use of the Sites and/or the services made available to the user through the Sites.

The user agrees to provide true, updated, complete and correct information, always and only corresponding to his/her own identity (it is forbidden to provide data of third parties) through any data collection channel published on the Sites, such as registration or subscription forms, contact forms, suggestion forms, contracting forms and/or any other data request form on the Sites, by sending an e-mail to BeeDIGITAL or, through postal communication, as indicated below.

The user is the only source of information about his personal data, and BeeDIGITAL therefore requests that, in order to keep his data updated and up to date at all times in accordance with the principles of data protection legislation, he informs the address indicated for the exercise of the rights set out in this Policy of any changes to such data. In any case, when the data is collected or provided directly from the user concerned, in accordance with the provisions of current legislation, the data provided by the user will be considered accurate until the user updates or rectifies them in BeeDIGITAL.

6. Special category data.

BeeDIGITAL neither requests nor requires through the Sites information or data of special categories of users, understood as, in accordance with current legislation, data revealing ethnic or racial origin, political opinions, religious or philosophical convictions, or trade union membership and genetic data, biometric data aimed at uniquely identifying a natural person, data relating to physical or mental health, data relating to the sex life or sexual orientations of a natural person.

In the event that BeeDIGITAL should at any time require this information from the user, it will request the user’s express consent to collect and use this information, informing the user, beforehand and unequivocally, of the purpose of the collection and processing of this information.

Consequently, in the event that for any reason – and without having been requested by BeeDIGITAL – such information is voluntarily communicated by the user to the aforementioned entity, such communication will imply the existence of a declaration of express consent by the user with respect to the processing of his/her data by BeeDIGITAL.

7. Purposes for which the personal data is used.

The user who accesses BeeDIGITAL’s Sites and voluntarily provides personal information to browse the Sites in a personalised manner or to use any service that requires the communication of data is informed of the following purposes for which BeeDIGITAL may process his or her personal data.

7.1 Registration on the Sites. When the user registers in any of our Sites, the personal data provided for this purpose, will be processed to manage the registration, as well as those generated as a result of the use of the services of the Sites through your username/s and password/s.

When the user registers for the services published on the Digital Presence BeeDIGITAL, in order to publish content through the services provided for this purpose, we will process the user’s personal data in order to manage the subscription to the service, as well as to manage and guarantee the publication of the user’s content and, where appropriate, to publish the user’s status as author or owner of the content. BeeDIGITAL will also process your data to verify, if necessary, your status as owner of the intellectual property rights or legitimate licensee of the same.

7.5 PaginasAmarillas.es online registration service. When the user uses the online registration service at paginasamarillas.es, BeeDIGITAL will process the user’s personal data in order to attend to and manage the service registration.

7.6 Information, Suggestions and Contact Service. When the user uses the services provided for this purpose to send suggestions or contact BeeDIGITAL (via forms, telephone, post or e-mail), we will process the user’s personal data in order to deal with and manage the response to the suggestion or request made by the user.

8. Processing purposes common to the collection of the user’s personal data through the registration and use of all the services of the Sites.

8.1 On a voluntary basis and with a legitimate basis in the consent given by the user to BeeDIGITAL, where applicable, by ticking the boxes provided for this purpose on the data collection forms published on the Sites:

a. To send the user, by post, e-mail and other equivalent means of electronic communication, commercial and advertising communications about BeeDIGITAL’s services and products relating to digital marketing and directories.

b. To know, segment and profile the browsing and advertising habits of the user’s business in order to adapt BeeDIGITAL’s products and services to the user’s preferences and tastes.

c. To collect information through tracking and tracing technologies (cookies) on the user’s activity when receiving commercial and advertising communications sent by BeeDIGITAL, in relation to whether the user receives the communication, when he/she opens it and the links he/she accesses, all with the aim of gathering statistics on the use of BeeDIGITAL’s Sites, measuring the success of the advertising campaigns carried out by this company as well as the response rates and knowing, segmenting, browsing and advertising habits by creating user profiles.

In any case, the user is informed that the purposes of the processing of his personal data collected through the forms included in the Sites will be explained by means of informative texts published in the forms themselves, and when so required, as stated above, BeeDIGITAL will request, through the boxes provided for this purpose, the user’s consent for the processing of his personal data when the legal basis for such processing is based on obtaining the user’s consent.

8.2 On the basis of legitimate interest:

a. To keep the minimum essential data of the user who objects to BeeDIGITAL sending him/her commercial and advertising communications, in order to be able to identify him/her and adopt the necessary measures to prevent the sending of commercial and advertising communications.

9. Recipients of the user’s personal data.

On the basis of the processing of personal data described in the previous section, BeeDIGITAL informs the user that it intends to communicate his personal data to the following third parties as indicated below:

9.1 Disclosures on the basis of legitimate interest:

a. BeeDIGITAL will publish the personal data of the user as a merchant, entrepreneur and professional in the various BeeDIGITAL directories contained in any medium for the purpose of commercial exploitation and public consultation of the same by third parties.

9.2 Voluntary transfers with a legal basis in the consent granted by the user:

To the users of BeeDIGITAL’s official pages on social networks, in which case, it will be up to the user to decide on the transfer of his/her data to third parties, in accordance with those parts of the service whose use allows him/her to voluntarily share information with other users of BeeDIGITAL’s official pages.

9.3 Processors.

BeeDIGITAL contracts with various entities that provide pre-sales services, telesales of advertising services, advertising production, after-sales services, IT support and recovery services, through data processing contracts to support the processing purposes indicated in this policy.

9.4 BeeDIGITAL informs the user that any other communication of personal data to be made will be made known to the user when so provided for by current legislation, informing the user in a precise and unequivocal manner of the recipients of the information, the purpose for which the data will be used and the nature of the data transferred or, where appropriate, when the legislation so provides, the user’s unequivocal, specific and informed consent will be requested beforehand. To this end, the user must pay special attention to the information provided in each case in the personal data collection forms published on the Sites and in this policy.

10. Exercise of rights.

BeeDIGITAL informs the user of the possibility of exercising, under the terms determined by the applicable regulations, the rights of access, rectification, deletion, limitation of processing, opposition, portability and the right not to be subject to a decision based solely on automated processing, including profiling. BeeDIGITAL will respond to your request, keeping the minimum data necessary to adopt the necessary measures to prevent the sending of such commercial communications.

12. Data retention period.

BeeDIGITAL will keep the user’s personal data for as long as the processing is maintained and the user does not request its deletion.

13. International transfers.

In the event that the user is a trader, businessman and/or professional, BeeDIGITAL may transfer his personal data with the authorisation of the Spanish Data Protection Agency, for the sole purpose of being in charge of the processing.
